these valet parking terms & conditions apply to and will form the terms and conditions for the provision of our Valet Parking service at a venue. our client has, by using our services agreed to these valet parking terms and conditions and has also confirmed all of their guests or attendees have been advised in advance of our general terms and conditions and also agree to these valet parking terms and conditions. by allowing your car to parked by us, you reiterate your agreement to these valet parking terms and conditions.
in these valet parking terms & conditions:
"vp", "the company", "we", "us" and "our" shall be a reference to valetparked.co.uk Limited and each other operating company in the vp group of companies
"you" or "the driver", means a person who uses the valet parking service and is not someone who we have a direct contact with and is merely a user of the service
"the customer" means a person or organisation who has entered into a contract with us for the valet parking service
"valet parking service" means the provision of valet parking services and associated services to the customer
"booking" means the reservation and payment for the valet parking services
"valet parking terms & conditions" means these terms and conditions
"general terms & conditions" means the terms and conditions encompassing our entire service detailed here and are in addition to these terms and conditions
"venue" means the location where the valet parking service is carried out
"valet parking greeting point" means the collection and delivery area provided for the operation of the valet parking service
"vehicle(s)" means any vehicle used to convey passengers or items that uses the valetparked.co.uk ltd service including any mechanical device on wheels or tracks, its equipment, accessories and everything that may be left in or on it
"our custody and control" means when we are driving the vehicle either to or from the valet parking greeting point
"parking area" means the location that the vehicle is parked in.
3.1 when at the valet parking greeting point, you must drive carefully and responsibly. you must also ensure that any children and animals are properly supervised and are at all times accompanied when they are at the valet parking greeting point. please take care to be aware of all vehicles in motion within the valet parking greeting point. when you have parked your vehicle in the valet parking greeting point, it is your responsibility to:
3.1.1 provide a working, suitable and useable key or fob to start and stop the vehicle;
3.1.2 fully close all windows of your vehicle;
3.1.3 apply your handbrake properly;
3.1.4 not leave any animal or person within your vehicle;
3.1.5 remove any valuables from your vehicle;
3.1.6 ensure that your possessions are placed in a locked boot or compartment and are not on display. we cannot be held responsible for any loss or damage whatsoever occurring to your vehicle or possessions within it resulting from your failure to do these things. we do not accept any valuables or other articles for safe custody.
3.1.7 obtain and keep safe a valid valet parking service ticket from us for your vehicle. a vehicle will not be returned without one;
3.2 you must comply with all directional signage and other instructions given by our representatives when in the valet parking greeting point.
3.3 you should ensure that you leave with us only your ignition key, the key to your driver’s door and the key for any security or immobilisation device fitted to your vehicle. we accept no liability for any loss or damage suffered by you to your vehicle where you leave other keys with us.
3.4 by leaving your vehicle with us, you warrant that (at all times while in our custody and control) the vehicle is roadworthy, has a valid MOT, that it's vehicle tax is current and paid and is properly insured so as to comply with all relevant legislation in the United Kingdom and has any local taxes or charges paid for. you hereby indemnify us in respect of all claims, losses, damages, costs and expenses suffered by us arising from any breach of this warranty. you accept liability for all harm suffered by third parties as a result of any breach of this warranty. this is deemed by us to be the case for the whole duration while the vehicle is in our custody and control. any liabilities incurred by us as a result of the customer’s vehicle not complying with the Road Traffic Act, you will be the one who is responsible for, including all costs/liabilities incurred by the company.
3.5 by leaving your vehicle with us, you warrant that the vehicle has sufficient fuel for the purpose of the valet parking service. you hereby indemnify us in respect of all claims, losses, damages, costs and expenses suffered by us arising from any breach of this warranty. you accept liability for all harm suffered by third parties as a result of any breach of this warranty. this is deemed by us to be the case for the whole duration while the vehicle is in our custody and control. any liabilities occurred by us as a result of the vehicle not complying with this clause, you will be the one who is responsible for all costs/liabilities incurred by the company.
3.6 for the avoidance of doubt, if your vehicle is not requested for return 10 minutes before our contract expiry, we will leave your keys with our client for you to make your own arrangements for collection and our responsibilities as set out above will terminate immediately.
4.1 we are responsible for ensuring that your vehicle is driven carefully by us between the valet parking greeting point and the parking area and our representatives are insured for any loss or damage to your vehicle which occurs as a result of our negligence during that process.
4.2 we will not be held responsible for any claims or losses as a result of the choice of parking venue, this includes, but is not limited to, parking tickets, parking infringements charges or any other parking charges.
4.3 we will not be held responsible for any claims of any nature below £250.00 (two hundred and fifty pounds) including any alleged dents, bumps and scratches.
4.4 we will pay for the reasonable cost of repairing any damage to your vehicle which is caused by the negligent driving of our representatives while they are providing the valet parking service, but the aggregate liability of us to you shall be limited to £20,000 (twenty thousand pounds).
4.5 we cannot accept liability for any mechanical, electrical or structural failure of any part of your vehicle including windscreens, glass, tyres, alarms, immobilisers, flat-batteries, tyres and in particular alloy wheels howsoever caused. this list is not exhaustive.
4.6 in the event that the car acquires a puncture whilst in our possession (including slow punctures) we reserve the right to charge either to inflate the tyre or for the changing of the tyre. we do not accept liability for punctures whilst in our custody or control.
4.7 we do not take any responsibility for deterioration in the condition of the vehicle during the valet parking service.
4.8 except as set out in this clause 4, we do not accept liability for damage to your vehicle (whether caused accidentally or by way of vandalism) while the vehicle is in the parking area or in the valet parking greeting point.
4.9 we accept no liability for any loss or damage whatsoever caused unless proved to be caused by the negligence of our employees.
4.10 we do not accept liability for theft of or from your vehicle.
4.11 the internal condition of the car is not checked at any time and no responsibility is accepted for the interior condition or any interior parts/accessories.
4.12 each vehicle is collected on a first come, first served basis, unless a specific time has been agreed in writing, in advance by us.
4.13 we do not accept any responsibility for delays of our service, caused as a result of circumstances beyond our control, such as traffic congestion, delayed event start or finish, road accidents, security alerts, severe weather conditions or understaffing as ordered by the customer. this list is not exhausted.
4.14 we will not be responsible for any minor scratches or dents (whether marked on documents/visible on videos or not) which may not be responsible to identify in confined times and weather conditions.
4.15 we have no liability for any faulty cars alarm fobs, house or any other keys or valuables which are left on the key ring or inside the vehicle.
4.16 the customer should have a spare key to their vehicle which they take with them.
4.17 any claims for damages must be reported immediately to our staff immediately upon delivery of the vehicle.
4.18 any claims will not be considered in case they are reported after the vehicle has been returned to your possession or if there is a delay in reporting any claims that cannot be verified by us.
4.19 if any vehicle dose not starts due to a flat battery, we reserve the right to charge for our time in attempting to start the vehicle. we will not be held responsible for any consequences that may result us having to jump-start your vehicle.
4.20 in the event that your vehicle needs to be repaired as result of our negligence, it must be carried out by our own approved organisation. it will be your responsibility to deliver and collect the car from the garage at your own cost. we will not authorise or agree for any works to be carried out by dealerships even in the event of the vehicle forgoing its warranty. we will not make cash payments, but instead directly to the repairing party.
4.21 we cannot guarantee the safety of vehicles nor their contents. be aware that the parking venue may be an open-air surface compound.
4.22 we do not accept any liability if you lose your valet parking ticket and this is presented to the company by a third party who uses it fraudulently to take your vehicle.
4.23 loss or damage covered by your own insurance. no vehicles will be covered for theft/fire/flood/malicious damage or any other intervening act of nature whilst the vehicle is parked during the valet parking service. such cases will revert back to your insurer.
4.24 after you receive your valet parking ticket, the terms which apply are those which were on the website at that time. please do not assume that the terms which applied on one occasion when you used our service will continue to apply when you next use our service. they can be changed in different times.
4.24 we endeavour to deliver your vehicle back to you within 45 mins depending on traffic, weather conditions. during the busy period it may take more than 45 minutes.
4.26 we will not refund charges or any expenses for any delays on delivery and pickup.
5.1 the valet parking service is for guests of our customer only. staff, contractors and non guests are not covered by our service. any car that is established as not being entitled to use the service will have the service immediately withdrawn and the owner will have to make all their own arrangements in all regards.
5.2 the vehicle will only be collected and delivered to the valet parking greeting point once. further requests will be completed at an additional charge of £25.00 (twenty five pounds) per trip.
5.3 no passengers will be carried by us in the vehicle.
5.4 no additional journeys will be carried by us in the vehicle.
5.5 the customer agrees to at all times, mitigate any losses and expenses where a dispute has arisen.
5.6 the customer agrees that any resolution method chosen by the company is a satisfactory and agreed by both parties, avenue of resolution.
5.7 subject only to the provisions of these conditions no statement undertaking warranty or condition express or implied by law, trade, custom or otherwise shall apply to the contract.
5.8 the Customer shall indemnify the company against all actions, claims or demands by third parties against the company howsoever arising directly or indirectly in respect of or in connection with the service/goods or the contract by the company to supply the same upon the terms and conditions herein contained.
5.9 without prejudice to the foregoing the company shall in no circumstances be liable for any loss, damage, costs or expenses which exceed in the aggregate the price of the service.
5.10 if at any time any one or more of the provisions of the above clauses or sub-clauses is or becomes invalid, illegal or unenforceable in any respect under any law the validity and enforceability of the remaining clauses and/or sub-clauses hereof shall not in any way be affected or impaired thereby.
5.11 these conditions and each and every contract containing them shall be governed by the Laws of England and the customer will submit to the jurisdiction to the English Courts.
